Lochner v. New York is one of the Supreme Court’s great anti-precedents. Typically taught in law schools as an example of how judges should not behave, Lochner rested on a fabricated “right to contract” that, in effect, gave employers broad license to exploit their workers. The so-called right invented in Lochner and similar cases later formed the basis for decisions striking down the minimum wage and laws protecting workers’ right to organize.

Ahead of tonight’s State of the Union address, Spokane, Washington passed a law guaranteeing residents the right to paid sick leave when they or their family members fall sick, or to deal with sexual assault and domestic abuse.

A school cafeteria worker at Irving Middle School in Pocatello, Idaho was fired after giving a 12-year-old student a free lunch. The cafeteria worker, Darlene Bowden, said the girl was hungry but didn’t have any money to purchase the $1.70 lunch.
City Gives Workers Holiday Gift Of Paid Sick Leave
On Wednesday, New Brunswick, New Jersey passed a paid sick leave ordinance. That makes it the 27th place in the country to do so, as well as the eleventh city in the state.
The news was received with mixed support by advocates. It marks another step forward in the wave of legislation that has swept the country and helps address the fact that 40 percent of workers in the city previously lacked paid leave for their own or a family member’s illness. But it is also less robust than the policies adopted by other cities in New Jersey.
